The Courts are opening next week, but not the Court House. The Court House will generally be closed to the public, with hearings, trials, and conferences being tried by telephone or video conference. Think about that for a moment – having your day in court, but not being in court and not being with your lawyer. Going to court is already nerve-wracking and this new system makes the process ever so much more so.
I had my first telephonic hearing. I was on my phone, my client was on his phone, opposing counsel and her client were on their phones and we called to present our case on a conference call. It was awful. It did not matter that I prevailed. It was contrary to everything my client hoped would happen. He wanted his “day in court” and a telephone hearing just didn’t meet his expectations.
In addition, there is a tremendous backlog, because all of those cases which were scheduled during the pandemic need to be rescheduled before current filings will be scheduled.
Once again, I encourage you to consider no court divorce alternatives.
