Business Succession Planning

As a result of our clients’ continued reliance on our advice, we are experienced in counseling, documenting, and assisting with succession planning, both with respect to family owned business enterprises and also, general business succession and carry-forward management and ownership. As one of many aspects of business and retirement planning, we counsel our clients with regard to succession planning and implementation as a consequence of common triggering events:  death, disability, retirement, or termination of employment, as applicable.

Succession planning relies on experience in estate planning and estate administration to assure continuity in business operations and “going concern” divestitures rather than forced liquidations of business interests.  In each instance, appropriately crafted corporate shareholder agreements or LLC/LP Operating Agreements are essential to smooth transitions. We have extensive experience in drafting and assuring adherence to agreed terms and conditions of governance commitments by and among business owners.
